Part 5 | Tracking Technologies Regulation
One of the hottest areas of regulatory & litigation risk involves the use of website tracking technologies (i.e., pixels, cookies & web beacons) that send personal information to advertising platforms like Meta & Google. Both state and Federal rules apply to the use of these technologies by both HIPAA covered entities and non-health related providers. Many class action lawsuits have been filed under state wiretapping and privacy statutes, leading to multimillion dollar settlements. Often the website owner does not even know that these technologies are active on its site.
